1. INTRODUCTION AND AGREEMENT TO TERMS
1.1. Scope of Agreement. These Terms of Service ("Terms") constitute a legally binding agreement entered into by and between Rental AI Agents ("Company," "we," "us," or "our") and you ("User," "you," or "your") concerning your access to and use of the rentalaiagents.com website, any related applications, services, and content (collectively, the "Service"). The Service facilitates the rental of artificial intelligence agents for various tasks and purposes.
1.2. Acceptance of Terms. By accessing, browsing, or utilizing the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Service and must discontinue use immediately.
2. USER ACCOUNTS
2.1. Registration Obligations. To access certain features of the Service, you may be required to register for an account. You warrant that all information provided during the registration process is true, accurate, current, and complete. You further agree to maintain and promptly update your account information to keep it accurate and complete.
2.2. Account Security. You are solely responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We shall not be liable for any loss or damage arising from your failure to comply with this security obligation.
2.3. Account Responsibilities. You agree that you will not: (i) create an account for anyone other than yourself without permission; (ii) create multiple accounts; (iii) use another user's account without their explicit permission; or (iv) sell or transfer your account.
3. ACCEPTABLE USE POLICY
3.1. General Prohibitions. You agree not to use the Service for any purpose that is unlawful, prohibited by these Terms, or otherwise harmful to Rental AI Agents, its users, or third parties.
3.2. Prohibited Content and Actions. Without limitation, you agree not to: 3.2.1. Upload, post, transmit, or otherwise make available any content that is infringing, libelous, defamatory, obscene, pornographic, abusive, offensive, or otherwise violates any law or right of any third party. 3.2.2. Engage in any activity that could disable, overburden, damage, or impair the Service or interfere with any other party's use of the Service. 3.2.3. Attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks connected to the Service through hacking, password mining, or any other means. 3.2.4. Use any automated system, including without limitation "robots," "spiders," or "offline readers," to access the Service in a manner that sends more request messages to the Service's servers than a human can reasonably produce in the same period by using a conventional web browser. 3.2.5. Utilize the AI agents rented through the Service to generate, promote, or disseminate illegal, harmful, or discriminatory content, or for any form of harassment, deception, or unauthorized surveillance.
3.3. Compliance with Laws. You shall comply with all applicable local, state, national, and international laws, statutes, ordinances, and regulations regarding your use of the Service.
4. INTELLECTUAL PROPERTY RIGHTS
4.1. Ownership of Service and Content. All intellectual property rights, including copyrights, patents, trademarks, and trade secrets, in the Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by Rental AI Agents, its licensors, or other providers of such material.
4.2. User-Generated Output. Any output generated by the AI agents as a direct result of your input and use of the Service shall be considered your property. However, you grant Rental AI Agents a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and distribute such output for the purpose of operating, improving, and promoting the Service, provided that such use is anonymized or aggregated and does not identify you without your express consent.
5. DISCLAIMERS AND LIMITATION OF LIABILITY
5.1. "AS IS" Disclaimer. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, RENTAL AI AGENTS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
5.2. No Guarantees. Rental AI Agents does not warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected. We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.
5.3. Limitation of Liability. IN NO EVENT SHALL RENTAL AI AGENTS, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US FOR THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
5.4. Indemnification. You agree to defend, indemnify, and hold harmless Rental AI Agents and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of (a) your use and access of the Service, by you or any person using your account and password; (b) a breach of these Terms; or (c) your violation of any law or the rights of a third party.
6. TERMINATION OF ACCESS
6.1. Termination by Rental AI Agents. We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, in our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
6.2. Termination by User. You may terminate your account at any time by contacting us at [email protected] or by utilizing any available account management features.
6.3. Effect of Termination. Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
7. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed and construed in accordance with the laws of the jurisdiction where Rental AI Agents is incorporated, without regard to its conflict of law provisions. Any dispute arising from or relating to the subject matter of these Terms shall be settled by binding arbitration in said jurisdiction, in accordance with the rules of a recognized arbitration association.
8. GENERAL PROVISIONS
8.1. Modifications to Terms. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
8.2. Severability. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
8.3. Entire Agreement. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
